Giving birth prematurely is a very sensitive topic as parents pay a serious emotional toll during the treatment of their baby or in case of death. Unfortunately, the legislation in Bulgaria related to the rights of the newborn and the parents demonstrates the potential to aggravate the suffering. According to Bulgarian medical standards, the threshold between abortion and birth is the potential viability of the fetus. When the fetus falls outside the scope of the criteria for secure viability, the Bulgarian legislation stipulates that she/he should survive at least 72 hours to be considered born and, therefore, a person. During this “trial period”, the legal status of the newborn remains unclear.
